Los Angeles, CA. Nixon Peabody is expanding its Labor and Employment practice with the arrival of partner Benjamin Kim, who joins the firm’s Los Angeles office. Ben joins Nixon Peabody from Allen Matkins Leck Gamble Mallory & Natsis, LLP.
Ben represents employers on a wide range of employment and Occupational Safety and Health Administration (OSHA) matters. Those include OSHA compliance and defense of alleged OSHA violations, particularly those involving fatalities and serious injuries, as well as litigating cases in both federal and California state courts for alleged wage and hour, employment discrimination, workplace harassment, retaliation, wrongful termination, and disability accommodation violations.

Ben has extensive experience working with various state and federal agencies. Among them, he has counseled clients on matters involving the California Department of Industrial Relations (including the Division of Occupational Safety and Health and the Division of Labor Standards Enforcement), the California Department of Fair Employment and Housing, the U.S. Equal Employment Opportunity Commission, and the U.S. Department of Labor (including the Occupational Safety and Health Administration and the Mine Safety and Health Administration).

A member of the Orange County Executive Advisory Council of Asian Americans Advancing Justice, Ben is also an advisory member of the Asian Rehabilitation Service, and serves as a board member of the Berkeley Korean-American Alumni Association. He earned his JD from the University of California Berkeley School of Law at Boalt Hall, and received his BA from the University of Arizona.
