On January 16, 2013, in a 71-page opinion, Judge Margaret Morrow of the United States District Court for the Central District of California dismissed a securities class action lawsuit against Simpson Thacher-client Lion Capital, an alleged lender of American Apparel with representation on American Apparel’s board.
Plaintiffs had alleged that Lion Capital was a control person of American Apparel. The Simpson Thacher team included Chet Kronenberg, Michael Freedman and Rachel Agress in the Los Angeles office. Mr. Kronenberg argued the motion to dismiss on behalf of Lion Capital.
